There is a lot of confusion surrounding our field. I want to give you 6 criteria or elements you absolutely, positively must have in any solution you obtain:
1: Be sure you are dealing with someone reputable when it comes to something so important as your home and your finances! Contracts are only as good as the people behind them. Anybody can agree to anything. The question is can they perform! Do your due diligence and check on the people with whom you are doing business! Do not be afraid to ask for references. Check with the Better Business Bureau, or though that is of limited help, you would want to know if anyone has entered a complaint.
2: Be sure you are presented with a clear market analysis. Be sure you know, the average days on market for your neighborhood and what the five-year one year and three months trends are. How can you make an important, unemotional decision without access to objective data!
3: Be sure your buyer shows you evidence of proof of funding, not just a token bank preapproval.
4: Make sure that your transaction is "arms-length" and closed at a reputable attorney's office.
5: All agreements should be in writing. Do not be afraid to get the opinion of your CPA or attorney.
6: You must be happy with the outcome. If you are not getting the absolute best outcome under the circumstances, then it is not win-win. I repeat, you must be happy with the outcome and agree that it was your best option, given all the facts.
